Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DepositResolve website, tools, and services (collectively, the "Service") operated by DepositResolve ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Nature of Service

DepositResolve is a self-help document preparation platform. We provide tools that help users organize information and generate formatted documents related to security deposit disputes, including demand letters, dispute letters, evidence packets, and small claims court preparation materials.

1.1 Not a Law Firm

DepositResolve is not a law firm, does not provide legal advice, and does not practice law. No attorney-client relationship is created between you and DepositResolve by your use of the Service. The information provided through the Service is general in nature and is not a substitute for professional legal counsel.

1.2 No Legal Advice

Nothing on this website or in any document generated through the Service constitutes legal advice. The Service provides general legal information and document formatting tools. Your use of the Service does not create a lawyer-client, advisory, fiduciary, or other professional relationship.

2. User as Author

You, the user, provide all facts, claims, and information used to generate documents through the Service. All documents produced by the Service are authored by you. DepositResolve serves solely as a formatting, organization, and document preparation tool. You are responsible for the accuracy, completeness, and truthfulness of all information you provide and all documents you send or file.

3. Publisher and Software Exemption

DepositResolve operates as a self-help legal information publisher and software tool. The Service assembles and formats documents based entirely on information provided by you, the user. DepositResolve does not exercise independent legal judgment on your behalf, does not select legal remedies for you, does not evaluate the merits of your claims, and does not predict the outcome of any legal proceeding.

The Service functions as a document preparation tool analogous to a legal forms publisher. Under applicable federal and state law, including First Amendment protections afforded to publishers and the software/document-preparation exemptions recognized in numerous jurisdictions, the assembly of documents from user-provided information without the exercise of independent legal judgment does not constitute the practice of law. You direct the content; the Service organizes and formats your input into a structured document.

4. Use of Artificial Intelligence

The Service uses artificial intelligence ("AI") technology to assist with document formatting, general legal information lookup, and content organization. You acknowledge and agree that:

  • AI-generated output may contain errors, inaccuracies, or omissions.
  • AI output does not constitute legal advice and should not be relied upon as such.
  • You are solely responsible for reviewing, verifying, and approving all AI-assisted content before use.
  • AI technology is used as a tool to assist you; the final document remains your work product.

5. No Guarantees of Outcome

DepositResolve does not guarantee any particular result or outcome from using the Service. The outcome of any security deposit dispute depends on many factors beyond our control, including but not limited to: the specific facts of your situation, applicable state and local laws, your landlord's response, and court decisions. Past results obtained by other users do not guarantee or predict a similar outcome in your case.

6. Consult a Licensed Attorney

We strongly recommend that you consult with a licensed attorney in your jurisdiction before taking legal action. An attorney can provide advice tailored to the specific facts and laws applicable to your situation. If you cannot afford an attorney, many jurisdictions offer free or low-cost legal aid services, law school clinics, and bar association referral programs.

7. Commercial Lease Limitations

The Service is designed for residential security deposit disputes. With narrow exceptions (such as California Civil Code § 1950.7), commercial security deposits in the United States are governed by contract law rather than statutory tenant protection schemes. The statutory information, deadline calculations, and document templates provided by the Service are based on residential statutes and may not apply to commercial lease deposits.

If your dispute involves a commercial lease, you should consult a commercial real estate attorney. The Service does not provide analysis of commercial lease terms, UCC security interest provisions, or contract-only deposit obligations.

8. State-Specific Notices

Certain states require document preparation services to register or provide specific disclosures. DepositResolve complies with applicable state registration requirements, including:

  • Arizona: DepositResolve is not a Legal Document Preparer (LDP) registered with the Arizona Supreme Court. The Service provides general legal information and self-help document formatting tools. The Service does not select legal forms or exercise legal judgment on behalf of Arizona users.
  • California: DepositResolve is a self-help legal information publisher. Pursuant to California Business & Professions Code § 6400(b)(2), the Service provides general legal information to the public. The Service does not provide personal legal advice or make legal determinations for California users.
  • Florida: DepositResolve is not an attorney and is not authorized to practice law in Florida. In accordance with Florida Statute § 559.955, the Service provides document preparation assistance at the user's direction. The user is responsible for the legal sufficiency of all documents. The practice of law in Florida by a non-attorney is prohibited under Florida law.
  • Nevada: DepositResolve provides document preparation services. In accordance with NRS § 240A, the Service assists users in preparing documents based on information provided by the user. The Service does not provide legal advice or representation.

9. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

10. Payments and Refund Policy

10.1 Pricing

Certain features of the Service are available for free (such as the deadline calculator). Other features require a one-time payment. All prices are listed in U.S. dollars and are displayed on the Service at the time of purchase.

10.2 Digital Products

Because the Service delivers digital products (generated documents, analysis reports, and preparation materials), all sales are final once the digital product has been delivered. We do not offer refunds after delivery of the purchased product.

10.3 Exceptions

In cases of technical malfunction where the Service fails to deliver the purchased product, or where a duplicate charge occurs, we will work with you to resolve the issue. Contact us at support@depositresolve.com for assistance.

11. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEPOSITRESOLVE, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY DOCUMENTS GENERATED THROUGH THE SERVICE; (C) ANY OUTCOME OF A DISPUTE IN WHICH DOCUMENTS FROM THE SERVICE WERE USED; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO DEPOSITRESOLVE FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless DepositResolve, its owners, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) any documents you create, send, or file using the Service; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13. Privacy and Data

When you use the Service, we collect and store information necessary to deliver the products you purchase, including your email address, state of residence, and the case details you provide. This data is used solely to generate and deliver your documents, provide customer support, and improve the Service.

We do not sell, rent, or share your personal information with third parties for marketing purposes. We may use third-party service providers (such as payment processors and cloud hosting services) that process data on our behalf and are bound by confidentiality obligations.

14. Intellectual Property

The Service, including its design, features, code, and content (excluding user-provided content), is owned by DepositResolve and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. Documents generated through the Service using your information are your property.

15. Prohibited Uses

You agree not to use the Service to:

  • Generate documents containing false, misleading, or fraudulent information.
  • Harass, threaten, or intimidate any person.
  • Violate any applicable law, regulation, or ordinance.
  • Interfere with or disrupt the Service or its infrastructure.
  • Attempt to gain unauthorized access to any part of the Service.
  • Use the Service for any purpose other than personal, non-commercial security deposit disputes.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.

17. Modification of Terms

DepositResolve reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with any other agreements or policies referenced herein, constitute the entire agreement between you and DepositResolve regarding your use of the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and DepositResolve.
